I was charged with reckless driving and have a prior DUI. How do I keep from losing my license?
It sounds like you are facing a new reckless driving charge. If you’re convicted, you are facing a mandatory 30 day suspension of your driver’s license by DOL. Furthermore, the court could impose up to 364 days in jail and a $5000 fine. If you are on probation for your prior DUI, you could also be looking at more jail as a sanction for violating the terms of your probation.
There is no “loophole” or magical “get out of jail” card. You need an experienced and competent attorney to help you out. You need someone who can evaluate the evidence, and either bring some pretrial motions, or negotiate with the prosecutor to get you a reduction of the charge. If that fails, you need a good litigator who can take this to trial for you.
