The buyer in an installment contract sued our clients for a refund of $500,000 in payments made towards a $725,000 purchase before he defaulted. The court ruled in favor of the Sellers at a summary judgment motion. The court ruled that the payments were non-refundable, and our clients were allowed to keep the $500,000, as well as the real property that was the subject of the transaction.
